HBA-KMH H.B. 3068 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3068 By: Hinojosa Criminal Jurisprudence 4/19/1999 Introduced BACKGROUND AND PURPOSE Currently, the state can appeal a court's ruling for a new trial to the court of appeals. H.B. 3068 grants a defendant the right to appeal an adverse ruling on a motion for new trial or a motion for arrest of judgement. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 44.02, Code of Criminal Procedure, to provide that a defendant has a right to appeal an adverse ruling on a motion for new trial or a motion for arrest of judgement. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
