HBA-MPM H.B. 3345 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3345 By: Tillery Pensions and Investments 3/29/1999 Introduced BACKGROUND AND PURPOSE Currently, the Texas Local Fire Fighters Retirement Act does not apply to any municipality providing retirement benefits that was organized before September 1, 1989. H.B. 3345 authorizes those municipalities to fall under the protections of this Act if the membership of the fire department votes to do so. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3(a)(3), Article 6243e, V.T.C.S. (Texas Local Fire Fighters Retirement Act), to make this Act applicable to each municipality in the state that has a regularly organized fire department not consisting exclusively of volunteers, except a municipality that has effected a program providing retirement benefits for fire department personnel that was established by charter or ordinance before September 1, 1989, and where the members of that department have not voted to come under the provisions of this Act.
