HBA-GUM H.B. 3732 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3732 By: Solis, Jim Public Education 3/29/1999 Introduced BACKGROUND AND PURPOSE Current law requires the board of trustees of a school district to report an order placing a student in an alternative education program to a juvenile court if the violation occurs under Section 37.006, Education Code. Some districts also report students to juvenile courts who have been placed in alternative education programs due to conduct that is not criminal. H.B. 3732 exempts a student placed in an alternative program under Section 37.002(c) (Removal by Teacher), Education Code, from being reported to a juvenile court. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 37.010(a), Education Code, to prohibit the board of trustees of a school district or the board's designee from delivering to the authorized officer of the juvenile court a copy of the order placing, under Section 37.002(c), a student in an alternative education program. Makes a conforming change. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
