HBA-ATS, GUM H.B. 3807 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3807 By: Uher Judicial Affairs 66/24/1999 Enrolled BACKGROUND AND PURPOSE In 1995, the 74th Texas Legislature created a statutory court in Matagorda County. In 1997, the 75th Legislature extended the creation date to September 1, 2001. Due to the lack of funds available within the county, there is a need to postpone the creation date of the statutory county court. H.B. 3807 postpones the creation date of the county court until September 1, 2003. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2, Chapter 551, Acts of the 74th Legislature, Regular Session, 1995, as amended by Chapter 446, Acts of the 75th Legislature, Regular Session, 1997, to postpone the creation of the County Court at Law of Matagorda County from September 1, 2001, to September 1, 2003. The existing provision in Section 2 allowing the creation of this court at an earlier date, by order of the commissioners court, remains in effect. SECTION 2. Emergency clause. Effective date: upon passage.
