HBA-NMO, RBT H.B. 3818 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3818 By: Kuempel Natural Resources 7/22/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, trustees of the Canyon Regional Water Authority (authority) were appointed every year and served one year terms. H.B. 3818 provides that trustees of the authority serve two-year staggered terms, and provides a transition procedure. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amend Section 3.04(a) and (b), Chapter 670, Acts of the 71st Legislature, Regular Session, 1989, to provide that trustees of the Canyon River Water Authority serve two-year staggered terms, rather than one-year terms. Makes conforming changes. SECTION 2. Requires trustees appointed in 2000 to draw lots to determine which six trustees serve a one-year term and which six trustees serve a two-year term. Provides that trustees appointed in 2001 and subsequent years serve two-year terms. SECTION 3. Emergency clause. Effective date: upon passage.
