HBA-JRA H.B. 960 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 960 By: Counts Land and Resource Management 3/2/1999 Introduced BACKGROUND AND PURPOSE Chapter 231, Local Government Code, allows the commissioners court of Garza County to zone a prescribed area around Lake Alan Henry. Currently, these zoning regulations must be designed to facilitate the adequate provision of transportation, water, sewers, parks, and other public requirements, and to assist in developing the area into parks, playgrounds, and recreational areas. In accordance with this statute, the Sam Wahl Recreation Area has been developed at Lake Alan Henry. Garza County and the City of Lubbock would like to be able to encourage further commercial and residential development of this area. H.B. 960 authorizes the commissioners court of Garza County to zone the Sam Wahl Recreation Area for commercial or residential development. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter G, Chapter 231, Local Government Code, by adding Section 231.141, as follows: Sec. 231.141. REGULATION OF SAM WAHL RECREATION AREA. Authorizes the commissioners court of Garza County to zone the area adjacent to Lake Alan Henry known as the Sam Wahl Recreation Area for commercial or residential development. Authorizes a municipality owning property in the Sam Wahl Recreation Area to develop, change the use of, or dispose of the property, notwithstanding this chapter, Chapter 253 (Sale or Lease of Property by Municipalities), or other law. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
