HBA-MSH, SEP H.B. 119 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 119 By: West, George "Buddy" County Affairs 7/18/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, to have a name printed on the ballot as a candidate for director of the Ector County Hospital District, a person was required to file a petition with the secretary of the board of directors of the district not later than the 31st day before the election. This provision did not leave sufficient time for the elections administrator to print ballots, mail them, and have them returned in time for early voting. House Bill 119 increases the amount of time the administrator has to print, mail, and receive ballots by making the filing date not later than 5 p.m. of the 45th day before the election. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 119 amends law to change the date by which a petition for a place on the ballot for the board of directors of the Ector County Hospital District must be filed with the secretary of the board of directors from not later than the 31st day before the date of the election to not later than 5 p.m. of the 45th day before the election. EFFECTIVE DATE May 14, 2001.
