HBA-CMT H.B. 2026 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2026 By: Yarbrough Licensing & Administrative Procedures 4/25/2001 Introduced BACKGROUND AND PURPOSE Currently, there are two types of permits for the wholesale distribution of wine and malt liquor in this state: the local class B wholesaler's permit that allows for the sale of wine and malt liquor only in the county in which it is issued and the general class B permit which allows for the sale in any county of the state. House Bill 2026 abolishes the local class B wholesaler's permit for the distribution of wine and malt liquor. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2026 amends the Alcoholic Beverage Code to abolish the local class B wholesaler's permit to sell wine and malt liquor. The bill repeals provisions of the Alcoholic Beverage Code pertaining to local class B permits. The bill authorizes the holder of a local class B wholesaler's permit on the effective date of the bill to convert that permit to a general class B wholesaler's permit on payment of the appropriate fee and in accordance with procedures for the conversion adopted by the Texas Alcoholic Beverage Commission. EFFECTIVE DATE September 1, 2001.
