HBA-SEP H.B. 32 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 32 By: McClendon Economic Development 2/23/2001 Introduced BACKGROUND AND PURPOSE The 2000 Sunset Advisory Commission found that the Texas Department of Economic Development (department) governing board and executive management of the department have not developed and implemented a clear focus and direction for the agency, do not have the necessary information, and have not taken an active enough role in overseeing the department. To better manage the agency, the Sunset Advisory Commission staff recommended reducing the nine-member governing board to five members. House Bill 32 reduces the department's governing board to five members. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 32 amends the Government Code to reduce the size of the governing board of the Texas Department of Economic Development from nine members to five. The bill provides that members shall serve staggered six-year terms with the terms of either one or two members expiring February 1 of each odd-numbered year in accordance with the Texas Constitution. The bill sets forth provisions to govern the transition from a nine-member governing board to a board composed of five members. EFFECTIVE DATE September 1, 2001.
