HBA-LJP H.B. 3628 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3628 By: Green Natural Resources 7/3/2001 Enrolled BACKGROUND AND PURPOSE The Texas Constitution authorizes the creation of water control and improvement districts to supply and store water for use, operate sanitary wastewater systems, and provide irrigation, drainage, and water quality services. On January 16, 2001, the Hays County Commissioner Court adopted a petition for the creation of Hays County Water Control and Improvement District No. 1 (district) to cope with the continual growth of the Hays County area. House Bill 3628 validates the creation of the district, subject to voter approval at a confirmation election. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3628 amends law to validate the creation of the Hays County Water Control and Improvement District No. 1 (district) by the Hays County Commissioners Court (commissioners court) on January 16, 2001, subject to voter approval at a confirmation election. The bill sets forth provisions relating to the district's boundaries, powers, and duties. The bill also sets forth provisions relating to an entity, including any public utility or retail public utility, expanding the provision of retail water or sewer utility service within the boundaries of the district. EFFECTIVE DATE June 16, 2001.
