HBA-NIK S.B. 1443 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1443 By: Barrientos Land and Resource Management 5/17/1999 Engrossed BACKGROUND AND PURPOSE Currently, Texas law exempts a building, other structure, or land under the control, administration, or jurisdiction of a state or federal agency from municipal zoning ordinances. Some cities have interpreted this law to also include private property that is leased to state agencies. This could result in the state leasing substandard space that puts state employee's health, safety, and property at risk, in addition to being incompatible with neighboring property use. S.B. 1443 establishes provisions regarding the application of municipal zoning authority to certain private property leased to the state. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 211.013, Local Government Code, by adding Subsection (d), to provide that this subchapter (General Zoning Regulations) applies to a privately owned building or other structure and privately owned land when leased to a state agency. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
