HBA-MPM S.B. 1623 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1623 By: Fraser Public Health 5/11/1999 Engrossed BACKGROUND AND PURPOSE Current law limits financial assets accessible by individuals who receive state support from a state school. Trust funds which benefit recipients of state school services are currently limited to $50,000. S.B. 1623 increases to $250,000 the value of a trust fund allowed to benefit recipients of state school services. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 593.081(a), Health and Safety Code, to provide that if the resident is a beneficiary of a trust that has an aggregate principal of $250,000 or less, rather than $50,000 or less, the corpus or income of the trust is not considered the property of the resident or resident's estate for the purposes of this subchapter, and it not liable for the resident's support, maintenance, and treatment, regardless of the resident's age. SECTION 2.Emergency clause. Effective date: upon passage.
