HBA-BSM H.B. 2148 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2148 By: Uher Juvenile Justice & Family Issues 3/11/2001 Introduced BACKGROUND AND PURPOSE Under current law, a county is allowed to transfer the jurisdiction of a juvenile without the consent of the receiving court, or even without prior knowledge of the receiving court. Originally this provision was to allow the jurisdictional transfer when the entire family moved permanently to another county or when a juvenile was temporarily staying outside the county of residence when the offense occurred. During the last few years this provision has been increasingly misused. House Bill 2148 provides the receiving court the opportunity to consent to the transfer rather than accepting the mandated transfer without approval. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2148 amends the Family Code to authorize a juvenile court to transfer the case of a child who is on probation to another juvenile court if the receiving court consents to the transfer. EFFECTIVE DATE September 1, 2001.
