HBA-MPM H.B. 3264 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3264 By: Williams Human Services 4/11/2001 Introduced BACKGROUND AND PURPOSE Current law ensures that assisted living facilities in Texas deliver quality care. The Assisted Living Facility Licensing Act establishes minimum acceptable levels of care and provides that a violation of the minimum acceptable level of care is a violation of law. However, certain facilities are exempt from the provisions of the Assisted Living Facility Licensing Act, including certain boarding facilities, religious facilities, and facilities that provide personal care services to persons enrolled in a program that is funded and monitored by the Texas Department of Mental Health and Mental Retardation. House Bill 3264 exempts from the Assisted Living Facility Licensing Act a tax-exempt facility that provides residential services, vocational training, and personal care services to developmentally disabled adults, that serves as an educational and/or research site for an institution of higher education, and that is otherwise in compliance with local safety, sanitation, and quarantine laws. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3264 amends the Health and Safety Code to provide that the Assisted Living Facility Licensing Act does not apply to a facility that provides residential services, vocational training, and personal care services only to developmentally disabled adults, that serves as an educational and/or research site for one or more institutions of higher education and that is a tax-exempt organization under federal law, if the facility complies with local safety, sanitation, and quarantine ordinances and regulations. EFFECTIVE DATE September 1, 2001.
