HB 167, 63rd R.S.
Relating to the authority of each county in this state to regulate the platting and subdivisions of land, and the construction of buildings and other structures theron, in the unincorporated territory within each such county; defining and authorizing the establishiment of construction standards; authorizing cities, towns and villages exercise all such powers in the area of extraterritorial jurisdiction thereof; creating the county planning commission in each such county, prescribing the number, method of appointment, term of office, filling vacancies in office, and removal from office of members of such commission; making provision for the operation of such commission; making provisions relating to approval and filing of plats; authorizing the commissioners court of each county by order to establish standards and regulations for subdivision and platting of land, for construction standards, and for disposal of liquid and solid waste within the unincorporated territory of the county, to prescribe and charge filing fees and permit fees, and to provide for on-site inspection; prescribing the powers of the county planning commission; authorizing the commissioner's court to bring suit to enforce covenants; prescribing the method of appeal from decisions of the planning commission; authorizing bonds in connection with construction of roads, streets, and public facilities; providing a penalty for violation of this Act or of county regulations; making provision relating to nonconforming structures, exceptions for farm and agriculturally related structures and facilities, and exceptions for plans and applications approved under certain Federal statutes; providing a saving clause; providing for severability; repealing Chapter 436, Acts 55th Legislature, Regular Session, 1957, as amended (Article 662da, Vernon's Texas Civil Statutes), and Chapter 151, Acts 52nd Legislature, Regular Session, 1951 (Article 2372k, Vernon's Texas Civil Statutes); and declaring an emergency.
